2. "The Luckshack" refers to all physical Luckshack locations as listed under the Sellers page, except where specifically stated otherwise.
3. The website enables you to shop online from The Luckshack for a wide range of goods including collectibles, games, gaming accessories, and more ("Goods").

You agree to the terms and conditions outlined in this Terms and Conditions of use Agreement ("Agreement") with respect to our website (the "Site"). This Agreement constitutes the entire and only agreement between The Luckshack and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended by us at any time and from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.
Indemnification:
By using this website, you agree to indemnify, defend and hold The Luckshack and our partners, attorneys, staff and affiliates (collectively: "Affiliated Parties") harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the website.
Non-transfer clause:
Your right to use this website is not transferable. Any password or right given to you to obtain information or documents is not transferable and may only be used by you.
Third-Party Services:
We make use of third-party service providers, namely PostNet and courier companies in order to dispatch completed orders. By using our website, you confirm your understanding that we do not operate or control the services offered by any Third Parties. These parties, and not The Luckshack, are responsible for all aspects of processing, fulfillment and customer service.
YOU AGREE THAT USE OF SUCH THIRD PARTIES IS AT YOUR SOLE RISK AND IS WITHOUT WARRANTIES OF ANY KIND BY US, EXPRESSED, IMPLIED OR OTHERWISE INCLUDING WARRANTIES OF TITLE, FITNESS FOR PURPOSE, MERCHANT ABILITY OR NON-INFRINGEMENT. UNDER NO CIRCUMSTANCES ARE WE LIABLE FOR ANY DAMAGES ARISING FROM THE USE OF THESE SERVICES.
We however do our utmost best to safely package and protect all products ordered to minimize the risk of damage or loss.

Shipping and returns:

Customer Privacy:

Order cancellation:
We reserve the right to cancel any order that has not been paid for after a reasonable time (usually between 4 and 7 days). If you wish to have an order cancelled, please contact us with the order number as soon as possible.
Conclusion of sales and availability of stock:
The Luckshack will indicate the acceptance of your order by delivering the Goods to you or allowing you to collect them, and only at that point will an agreement of sale between you and The Luckshack come into effect (the “Sale”). This is regardless of any communication from The Luckshack stating that your order or payment has been confirmed. The Luckshack will indicate the rejection of your order by cancelling it and, as soon as possible thereafter, refunding you for any amount already paid.
We reserve the right to cancel and refund any order in the event that a pricing or stock level error occurs, whether such error was caused by a problem with the website software; or due to the product or its information being incorrectly captured.
Pre-order items:
PRE-ORDER ITEMS ARE STOCKS THAT WILL BE AVAILABLE NO EARLIER THAN THE DATE DISPLAYED ON OUR WEBSITE.
BEFORE ORDERING, PLEASE READ THE RULES & REGULATIONS BELOW:
1. Pre-orders require payment to be made within 4 days of ordering.
2. Please note that due to the nature of pre-order items, we will not be accepting cancellations after payment has been made.
3. The available/ship date is "best effort" and may change without prior notice due to factors outside our control (eg: customs, suppliers). We will ship orders the moment they are available.
4. If you combine in-stock and pre-ordered items, ALL items will be shipped once all pre-ordered items are available.
Payment Options accepted:
Payment may be made via Visa, Mastercard or by bank transfer into The Luckshack CC bank account, the details of which are supplied on your order confirmation, or on request.
Customer details separate from card details:
Customers' card details will not be stored by The Luckshack CC.
Merchant outlet country and transaction currency:
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. The transaction currency is South African Rand (ZAR).
Country of Domicile:
This website is governed by the laws of South Africa and The Luckshack CC chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, Office 1, Albar Centre, 1 Zastron Road, Milnerton, 7441.
Variation:
The Luckshack CC may, in its sole discretion, change this agreement or any part thereof at any time without notice.
